Islam spreads in Indonesia without violence, and preachers who came after them followed the path of their predecessors, calling peacefully. But the situation changed after the collapse of the Ottoman Empire. Indonesia's religious life has undergone a total change due to pressure from the Dutch government, keeping away Muslims from Arabic, politics and Islamic law. This research aims to find a suitable way how to prepare preachers and restores the best path in the call, and the Islamic call to the previous era of glory. Through the methods of descriptive analysis, and documentary study, I found that there is are phenomena of violence in the call that committed by a small group of preachers, that they do not have a little patience and use of force, which are contrary to the nature of the people of Islam in Indonesia. The teaching of Islam is far from the violent. It has been shown that the preachers of Indonesia need a greater range of knowledge and skills about cultures, religious and historical culture, linguistic, human nature, practcal aspect and real situation.

The purpose of this study is to find out the concept of khilafah according to Sayyid Quthub and Taqiyuddin al-Nabhani, differences and legal basis. This study is a library model, with primary data sources, the Zhilalal-Qur'anic Tafseer and Nizham Al-Hukmi Fi Al-Islam and qualitative descriptive analysis methods. The result is the thought of the concept of khilafah according to sayyid Quthub: 1). The concept of the ruler / caliph, that who becomes the ruler of the choice of the Muslims, acts in absolute freedom, but that person gets the authority because he constantly applies the law of Allah Almighty. 2). The Islamic government system, the Supra Nasional government (the unity of the entire Islamic world). 3). The pillars of his Islamic government: a). Justice of the ruler; b). People's obedience; c). Consultation between the people and the authorities. Thought of the concept of the Caliphate according to Taqiyuddin Al-Nabhani: 1). The concept of the ruler / caliph is a person who represents the Ummah in government affairs and power and in applying syara 'laws. 2). The system of government is khilafah. 3). The pillars of his Islamic government: a). Sovereignty in the hands of syara '; b). Power of the people; c). To appoint a legal Caliph fardlu for all Muslims; d). Only Khailfah has the right to carry out tabanni (adoption) against syara 'laws; e) The Caliph has the right to make constitutions and all other laws. The differences in the concept of khilafah are both: 1). According to Sayyid Quthub, if the ruler fails, then the ruler can be dismissed if the Muslims are no longer satisfied with him. This statement gives a signal that the people get rid of the rulers who no longer fulfill their functions (zhalim rulers). It is different from the opinion of Taqiyuddin al-Nabhani. An Amir al-mu'minin (Khalifah), even though he is responsible before the people and his representatives, but the people and their representatives are not entitled to dismiss him. Nor will the Caliph be dismissed, except when deviating from Shara law. The one who determined the dismissal was only the Mazhalim court. 2). The system of Islamic government according to Sayyid Quthub does not question any system of government in accordance with the system of conditions of society, but this government is characterized by respect for the supremacy of Islamic law (shari'ah). Whereas According to Taqiyuddin Al-Nabhani that the system of Islamic government is khilafah. 3). The pillars of Islamic government according to Sayyid Quthub and Taqiyyuddin al-Nabhani, points three parts a and b at the above conclusions are: 1). Sayyid Quthub: a). Justice of the ruler; b). People's obedience; c). Consultation between the people and the authorities. 2). Taqiyyuddin al-Nabhani: a). Sovereignty in the hands of syara; b). Power of the people; c). To appoint a legal Caliph fardlu for all Muslims; d). Only Khailfah has the right to do tabanni (adoption) against the laws of shara; e). The Caliph has the right to make constitutions and all other laws. The legal bases for determining the Caliphate according to both: 1). The legal basis for the establishment of the Caliphate according to Sayyid Quthub: 1). Ruler, Qur'an Surah (2) al-Baqarah verse 30; 2). Islamic Government System, Qur'an Surah (24) an-Nur verse 55; 3). Pillars of Islamic Government, Qur'an Surah (4) an-Nisa 'verse 58. 2). The legal basis for the establishment of the Caliphate according to Taqiyyuddin al-Nabhani: 1). Ruler, hadith of Muslim history from Abu Said Al khudri, Hadith no. 1853 and Muslims from Abdullah Bin Amru Bin Ash, Hadith no. 1844; 2). Islamic Government System, Al-Qur'an surah an-Nisa '(4) verse 59, an-Nisa' (4) verse 65. Muslim, saheeh Muslim, volumes, 3 pp., 1459 and 1480; 3). Islamic Pillars of Government al-Qur'an surah An-Nisa (3) verse 65, and Surah An-Nisa (3) verses': 5.

This article examines the inheritance issue of patah titi practiced by the people of Aceh Tengah. Patah titi is a state in which one of the aṣḥāb al-furūḍ (obligatory sharers or primary heirs) loses linkage (due to death) to muwārith (the deceased). This study used descriptive analysis and drew upon legal pluralism,which considers the interaction between state laws, customary laws, and religious laws in resolving a case. The findings show that inheritance distribution is implemented in three steps: first, the heir inherits nothing due to the legal consequences of patah titi; second, the heir receives inheritance because they are considered a badl (substitution) of the predeceased heir; third, the heir receives hibah (gift).The last two steps in the settlement of patah titi are derived from various sources, including the Compilation of Islamic Law (KHI), customary law,and the universal values of Islamic law, which consider principles of equity, humanity and child protection.

Sultanate of Bima has been bound by government of Dutch colonial with Lange Contract agreement (long contract), occurred in 1908-1909 That the Sultanate of Bima is a very strategic area. These conditions caused the VOC and the government of Dutch to seek intervention through the Lange Contract agreement (long contract) which has led to the entry of the Sultanate of Bima in the Pax Neerlandica neighborhood. War of Ngali occurred for several reasons namely 1) Feelings of dissatisfaction with the actions of the Dutch government which impose various tax rules in the Sultanate of Bima. 2) The Sultanate of Bima as part of the Dutch East Indies sovereignty was seized by a Lange Contract agreement in 1908. 3) Customary law and Islamic law were replaced by Dutch law. 4) The head or belasting duty system is denied and punished for taxing the unbelievers. The conclusion in this study is that people of Ngali against the government of Dutch colonial because they wanted to control the entire Milky, the resistance made by people Ngalisolely to maintain the customs, religions, and independence owned by the people of Bima.

Purpose: This paper examines the level of knowledge and awareness of the Jambi province community in issuing zakat through the e-commerce payment system.Design/Method/Approach: This study uses descriptive analysis by applying a quantitative approach to obtain information and collect the required data through google forms. Observation and literature study were also applied to expand the secondary data. The method is carried out to see the model of knowledge, awareness people pay zakat through e-commerce. Can it speed up the collection and distribution of zakat funds to people in need?Findings: The results showed that the level of knowledge and public awareness distribute zakat through e-commerce had a significant positive effect on the acceleration in the collection of zakat funds. The greater the level of knowledge and public awareness in the use of e-commerce, it can help accelerate the collection and distribution of zakat funds in Jambi Province.Originality/Values: The main contribution of this research is the existence of payment services and distribution of zakat funds by e-commerce which is very helpful and fosters awareness and knowledge of the Muslim community who wants to pay zakat without having to meet face to face, and Islamic law remains valid

The obligation of children to provide for their parents and the growing reality in Indonesia today, many children leave their parents but give up their livelihood obligations. The question arises how the practice of releasing children from their parents at the Wredha Harapan Ibu (PWHI) Nursing Home in Bringin Ngaliyan Semarang is a perspective of Islamic law and positive law. Article 46 Paragraph (2) Marriage Law Number 1 of 1974. The research author uses descriptive analysis method that is analyzing information about the real situation now. The study uses field research with interview and documentation methods as well as taking various supporting literature to be used as a reference in the preparation of this study. This research approach is normative. The results of the author's research: First, first entrusted until now the parents have never filled their children. Secondly, first of all, they are left with routine maintenance once fulfilled, but the habit does not last long. Third, the first deposited until now has never given a living, but still gives a living only rarely given. In Islamic law the release of parents' living is not in line with the teachings and recommendations of the Islamic religion which are stated in the Al-Quran and Al-Hadith as well as the agreement of the ulama as well as contrary to the positive law in force in Indonesia as stated in the Law Article 46 Paragraph (2) Law Number 1 of 1974 concerning marriage.

Wage of paddy labors in villages is mostly based on heredity habits. This practice occurs continuously in muamalah activities as in Pagersari village, Mungkid, Magelang. This research aims to analyze the wage of paddy labors in Pagersari village by looking at the condition of the people who do not understand the conformity of the practice with the  Islamic law rules about wage. The method used in this research was descriptive analysis with qualitative approach. The data collection techniques were using interviews, field studies, and documentation studies. Meanwhile the data analysis techniques covered the data reduction, the data presentation, and conclusion drawing. This research was done by people who practice the wage of paddy labors. The result of the research shows that those practices according to Islamic law are categorized in fikih muamalah; that is ijarah based on works (ijarah ala al a’mal) which has been fulfilled the contract basis (rukun akad). The wage received is bawon gabah with the comparison system 12:1, 13:1, and 14:1 from the harvest which is divided between the laborers and the farmers in kilogram units. The wage is categorized ajrul misli; that is worth it with the works and the working conditions. As seen from the appropriateness in Islamic law, the wage practice has fulfilled the worthiness and virtue elements. It just has not fulfilled the element of justice in the form of transparency in the distribution of wage in the balance.

Islamic banks are present in the community as financial institutions whose activities are based on the principles of Islamic law for the benefit of the people. This study aims to determine the strategic role of Islamic Banks as financial service institutions, the importance of the existence of Islamic Banks and Islamic-based markets and financial instruments in them. In its development, Islamic banks have a role as institutions that turn on public funds, channel funds to the public, transfer assets, liquidity, reallocation of income and transactions. In the Indonesian economic system, the existence of Islamic Banks is important as an alternative solution to the problem of conflict between bank interest and usury. Islamic financial markets and instruments provide a free society of interest and follow a different set of principles. Fines are sanctions or punishments that are applied in the form of the obligation to pay a sum of money imposed on the denial of a number of agreements previously agreed upon. There is debate over the status of fines in Islamic law. Some argue that fines may not be used, and some argue that they may be used. In the context of fines for delays in payment of taxes, in fiqh law it can be analogous to ta'zir bi al-tamlīk (punishment for ownership). This can be justified if the tax obligations have met the requirements. Whereas according to Islamic teachings, fines can be categorized as acts in order to obey government orders as taught in the hadith, and in order to contribute to the realization of mutual benefit in the life of the state. As for the amount of the fine, the government cannot arbitrarily determine fines that are too large to burden the people. Penalties are applied as a message of reprimand and as a means to cover the lack of the state budget.

With the majority of the population working in agriculture, the economy of Khmer people is mainly agricultural. At present, the Khmer ethnic group has a workingstructure in the ideal age, but the number of young and healthy workers who have not been trained is still high and laborers lack knowledge and skills to do business. Labor productivity is still very low ... Problems in education quality, human resources; the transformation of traditional religion; effects of climate change; Cross-border relations of the people have always been and are of great interest and challenges to the development of the Khmer ethnic community. Identifying fundamental and urgent issues, forecasting the socio-economic trends in areas with large numbers of Khmer people living in the future will be the basis for the theory and practice for us to have. Solutions in the development and implementation of policies for Khmer compatriots suitable and effective.

The utilization of e-commerce media in the trading world brings impact to the international community in general and the people of Indonesia in particular. For Indonesian people, This is related to a very important legal problem. The importance of law in the field of e-commerce is mainly in protecting the parties who transact through the Internet. The purpose of this study is to know the legal review of the buying and selling agreements through electronic media as well as to know the legal protections for sellers and buyers if one of the parties commits a default. The research uses a normative juridical method of approach and the discussion is done in a descriptive analysis. The source and type of data used are primary data and secondary data. While the data collection techniques using literature studies, and the data obtained will be analyzed qualitatively. The agreement to buy and sell through electronic media is a new phenomenon that has been implemented in various countries and regulated in the Civil state nor law ITE. Legal protection for the parties in the sale and purchase agreements through electronic media is governed by the consumer protection ACT. Any breach must respond to any loss arising from his or her actions.
