Pasal 5 Ayat (1) Peraturan Daerah Provinsi Daerah Istimewa Aceh Nomor 4 Tahun 1994 tentang Pendirian Perusahaan Daerah Pembangunan Aceh menyatakan bahwa Perusahaan Daerah didirikan dengan maksud dan tujuan untuk meningkatkan pendapatan asli daerah, turut berperan serta dalam pengembangan perekonomian daerah, memperluas pemerataan pembangunan dan hasilnya. Pengaturan penyertaan modal pemerintah Aceh tertuang juga dalam Qanun Aceh Nomor 16 Tahun 2013 tentang Penyertaan Modal Pemerintah Aceh Pada Badan Usaha Milik Aceh, Penyertaan Modal Pemerintah Aceh adalah pengalihan kepemilikan kekayaan Aceh yang semula merupakan kekayaan yang tidak dipisahkan menjadi kekayaan yang dipisahkan untuk diperhitungkan sebagai modal Aceh pada Badan Usaha Milik Daerah dengan prinsip saling menguntungkan. Tujuan penelitian untuk mengetahui dan menganalisis alasan pemerintah Aceh dalam melakukan penyertaan modal pada Perusahaan Daerah Pembangunan Aceh, untuk mengetahui dan menganalisis legalitas penyertaan modal Pemerintah Aceh pada Perusahaan Daerah Pembangunan Aceh, serta untuk mengetahui dan menganalisis bagaimana tanggungjawab Pemerintah Provinsi Aceh sehubungan dengan penyertaan modal pada Perusahaan Daerah Pembangunan Aceh. Metode penelitian yang digunakan adalah jenis penelitian hukum normatif (yuridis normatif) dan yuridis empiris dengan mengunakan data primer, data sekunder dan tersier. Hasil penelitian menunjukan bahwa pertama, adanya alasan hukum dan alasan politis Pemerintah Aceh dalam mempertahankan eksistensi Perusahaan Daerah Pembangunan Aceh, kedua, penyertaan modal Pemerintah Aceh pada PDPA mempunyai legal standing yang jelas, namun demikian, masih terdapat kelemahan-kelemahan dalam pengawasan. Ketiga, Pemerintah Aceh bertanggung jawab terhadap kekurangan penyertaan modal pada PDPA sebagaimana yang telah diatur dalam Perda  Nomor 4 Tahun 1994 Tentang pendirian PDPA, mengingat modal tersebut sangat diperlukan agar kegiatan operasional perusahaan dapat berjalan dengan lancar.Article 5 (1) of Local Law on Special Region of Aceh Province Number 4, 1994 regarding the Establishment of Local Enterprise of Pembangunan Aceh states that local enterprise is established with the aim of increasing the revenue, participating in regional economic development, broadening the development and its results. The regulation on Capital Participation of Aceh Government ruled in Qanun Aceh Number 16, 2013 regarding the Joint Capital of Aceh Government at the Local Enterprise of Aceh at the Aceh Government Enterprises, the joint of capital at the Government of Aceh is to transfer the owning of Aceh Treasury that is previously apart of the property that is not separated from the property to be accounted as the capital of Aceh at the Local Enterprises with the principle of reciprocity. This research aims to know and analyze the reason of Government of Aceh in jointing capital at the Aceh Local Enterprise of Pembangunan Aceh, to know and analyze the legality of joint capital of Aceh Government at the Enterprise of Pembangunan Aceh, and to know and analyze the responsibility of Aceh Government in relation to local enterprise of Pembangunan Aceh local enterprise. This is normative legal research (juridical normative) or doctrinal legal research and juridical empirical research by applying primary, secondary and tertiary data. The result of the research shows that firstly there is a legal and political reasons in defending the existence of to local enterprise of Pembangunan Aceh Secondly, the joint venture of Aceh’s Government in PDPA has a clearly legal standing nevertheless thee are weaknesses in the monitoring. Thirdly, the Government of Aceh is responsible towards the lack of joint venture of PDPA as ruled in the Local Regulation Number 4, 1994 on the PDPA Establishment as the capital is really needed in order to keep the company operation working well.

For more than forty years, the Yogyakarta Sultanate has applied discriminatory policy on law ownership to Chinese Indonesian. Historically, the Chinese descendants have not been able to own land except Building Rights or HGB. This policy was outlined in the Regional Head Instructions Number K.898/I/A/75. The research analyzes what is the legal basis of application the disminatory policy on land ownership for Chinese-Indonesia. The research uses normative and empirical legal research with constitutional and local regulation approach. The result of research shows that the Special Region of Yogyakarta imposed a Discriminative Land Ownership Policy to the Chinese-Indonesia is due to historical reason, when the Giyanti Agreement of 1755 sued the Chinese traitor group to the Sultanate. Since then, the Instructions Letter of the Regional Head of DIY PA. VII/No. K/898/I/A/75 was issued to Prohibit the Property rights of Non-Indigenous Indonesian citizens. The research recommends that the Government of Special Region of Yogyakarta should re-considers and reviews the time limitation of banning land ownership to Chinese-Indonesia in the light of respecting the constitutional rights of new generation of the Chinese-Indoensia. This recommendation, off course, needs some requirements for the Chinese-Indonesia such as statement of loyalty to the Sultanate and limitation of the area they may have land ownership.

The revocation of the Rural Bank (BPR) business license is inseparable from the function of the OJK in fostering and supervising the BPR. This study used an empirical legal research method, namely research was conducted at OJK Regional 3 Central Java and Yogyakarta Special Region. The results indicate that there are 2 legal protections provided by the government to depositors of funds, namely preventive and repressive legal protection. Preventive legal protection has the character of preventing problems, including the application of the principles of confidentiality and prudence. Meanwhile, the repressive legal protection that functions to resolve disputes that arise is the Deposit Insurance Corporation (LPS). Then the factors that cause the revocation of the BPR's business license are factors that come from internal BPRs that cannot manage the BPR properly. The revocation of the RB's business license was caused by 2 things, namely the revocation of the business license at the request of the shareholders and the revocation of the business license because the rescue efforts carried out did not bear fruit.

The existence of vagrants and beggars as a sub-culture of poverty is a separate problem for the government and the people of Yogyakarta in general. This research was conducted to examine and analyze the effectiveness of the Yogyakarta City Government Regional Regulation No. 1 of 2014 concerning the handling of homeless and human rights beggars in the review of maqasid shariah and seeks to find the crucial factors that influence the effectiveness of the DIY city government regulation based on a human rights perspective. humans in the view of maqasid syariah. The facts in the field were collected using qualitative methods with a sociological normative juridical approach and technical analysis using analytical descriptions. The results of this study are the Role and Functions of the Social Service in tackling Homeless and Beggars in the Special Region of Yogyakarta which has been procedurally fulfilled based on the Yogyakarta Regional Regulation No. 1 of 2014, but conceptually has not been fully implemented in the DIY City Regional Regulation No. 1 of 2014. In the perspective of human rights, in terms of quantity, the regional regulation has guaranteed the fulfillment of the rights of the homeless and beggars, the implementation is in accordance with standard operational procedures in the field. According to the Maqasid syariah perspective, the government's program to overcome sprawl has realized the maqasid syariah, namely the maintenance of religion (hifz din), reason (hifz al-aql) maintenance of the soul (hifz al-nafs) maintenance of offspring (hifz al-nasl) maintenance of property ( hifz al-mal)

<p align="center"><strong>Abstract</strong></p><p><em>The objective of research was to find out the existing condition of spatial layout the Kutai Kartanegara Regency’s Government used and to find out the policy of Kutai Kartanegara Regency’s Government in spatial layout. In this research, Empirical research on Law (ELr) was used. ELr seeks to understand and explain how law works in the real world. This study was a descriptive developmental one providing a systematical description on the object to be studied, and then a model was developed to address the problems in the field. The research approach used was qualitative approach. The research was taken place in Kutai Kartanegara regency. From the result of research and discussion, two conclusions could be drawn. Firstly, the existing condition of land use in Kutai Kartanegara regency showed the land use for various activities such as: mining, forestry, gardening, and farming. The shift of land function increased over years. Secondly, the government of Kutai Kartanegara regency had developed draft Local regulation of regency about rTrW or Zoning for Kutai Kartanegara regency, but it had not been proposed to the Local Legislative Assembly’s (dprd’s) discussion because there had been no provincial regulation about rTrW or Zoning of East Kalimantan province</em></p><p><strong><em>Key words : </em></strong><em>policy, Special layout, Valorisation</em></p><p align="center"><strong>Abstrak</strong></p><p>Tujuan penelitian adalah untuk mengetahui <em>existing condition tata ruang </em>yang digunakan Kabupaten Kutai Kartanegara, untuk mengetahui kebijakan Pemerintah Kabupaten Kutai Negara dalam penataan ruang. Dalam penelitian ini digunakan metode <em>Empirical research on Law (ELr). Pendekatan penelitian menggunakan pendekatan kualitatif. Lokasi penelitian meliputi Kabupaten Kutai Kartanegara. Dari Hasil penelitian dan pembahasan dihasilkan dua kesimpulan, yaitu : pertama, Kondisi existing Penggunaan tanah di Kabupaten Kutai Kartanegara untuk bermacam – macam kegiatan diantaranya yaitu : . Kegiatan  pertambangan  , Kegiatan Kehutanan , Kegiatan Perkebunan, kegiatan pertanian. Terjadi pengalihan fungsi lahan yang meningkat dari tahun ketahun Kedua, Pemerintah Kabupaten Kutai Kartanegara telah membuat Draft Rancangan Peraturan Daerah Kabupaten Tentang RTRW maupun Zonasi Kabupaten Kutai Kertanegara, hanya saja belum bisa diajukan dalam pembahasan dengan DPRD karena Peraturan Daerah Propinsi tentang RTRW maupun zonasi Provinsi Kalimantan Timur belum ada.</p><p><strong>Kata kunci : </strong>Kebijakan, tata ruang, valorisasi</p>

Socio-economic factors are always the benchmark of domestic life. There is an assumption that a household disharmony is caused by economic issues referred to as the highest number of divorce cases registered at Mahkamah Shari’a (Shari’s Court) of Aceh. This research is very important since Aceh is a special region in terms of religion and culture so that the number of divorces would not be this much and it is hoped that the government will issue a regulation that can reduce the number of divorces. The research data are obtained from BPS (the Central Bureau of Statistics) of Aceh Province and the Sharia Court of Aceh which then analyzed using descriptive quantitative methods. The results indicate that recur of friction (in a household) is the major cause of divorce in Aceh followed by the economic factor and domestic violence. The level of individuals’ education shows a significant influence on divorce along with the age when they first married, but children variable affected insignificantly. However, not all research in the same field has the same results as this study.

In Indonesia, the main discusssion in the dynamics of local autonomy is the establishment of local law product after the discussion of general elections. How come? Article 18 paragraph (6) of the 1945 Constitution regulates that in the framework of implementing autonomy and co-administration duties, the local Government has the right to stipulate local regulations and other regulations. Practically, other regulations can be form as local head regulation and many kind of legal policy which made by head of local government. It can be imagined, how many local law products were established in one year in 34 provinces and 265 cities/regency. In this perspective, it is important to raises the object of Local Head Regulations as a miniature of government duties as a derivative of the Local Regulation. The problems which arrise is what is the position of local head regulation in the national legal development. This paper was conduct by doctrinal approach. The specifications which used is descriptive analysis by inventorying and identifying problems that related to harmonization and synchronization of local law products based on Law Number 12 Year 2011 concerning the Establishment of Regulations and Law Number 23 Year 2014 concerning Local Government. Analysing method is normative qualitative by using gramatical and systematic interpretation.In this study, it was found that local head regulation is a part of local law products in the form of legal policy which called as beleidregels. Based on that form, if there any substantive problems from the legal policy so it could not be tested in the legal procedure because the legal policy was made based by the freedom of government. Thats why the government should create an alternative solution to solve the substantive problems from the local head regulation as a legal policy.

Nagan Raya salah satu Kabupaten yang ada di Provinsi Aceh yang mempunyai ekosistem gambut, dalam rangka pemeliharaan ekosistem gambut sebagaimana diatur di dalam Pasal 33 Peraturan Pemerintah Nomor 71 Tahun 2014 tentang Pengelolaan dan Perlindungan Ekosistem Gambut menyebutkan “pemeliharaan ekosistem gambut sebagaimana dimaksud dalam Pasal 17 ayat (1) huruf  b dilakukan melalui upaya pencadangan ekosistem gambut dan pelestarian fungsi ekosistem gambut sebagai pengendali dampak perubahan iklim. Pemerintah Kabupaten Nagan Raya telah menetapkan ekosistem gambut dengan fungsi lindung dalam Pasal 27 ayat (2) Qanun Kabupaten Nagan Raya Nomor 11 Tahun 2015 tentang Rencana Tata Ruang dan Wilayah Kabupaten Nagan Raya kawasan lindung gambut sebagaimana dimaksud pada ayat (1) seluas 11.380,71 ha terletak di Kecamatan Darul Makmur, berada di Gampong Babah Lueng, Kuala Seumayam, Pulo Kruet, dan Sumber Bakti. Praktinya, ekosistem gambut tersebut telah dimanfaatkan sehingga fungsi dari kawasan tersebut telah beralih. Hasil penelitian ini menunjukkan bahwa upaya pencadangan dan pelestarian fungsi ekosistem gambut di Kabupaten Nagan Raya tidak dilakukan secara maksimal sehingga eksploitasi rawa gambut masih terus terjadi pada ekosistem gambut dengan fungsi lindung.Nagan Raya is one of regencies in Aceh Province that has peat ecosystem region, concerning the protection of peat ecosystem as regulated in Article 33 of the Government Regulation Number 71, 2014 regarding Ecosystem Management and Protection of peat states that an effort of taking care peat ecosystem as worded in Article 17 ( 1 ) point b is done through the reservation of peat ecosystem and conservation function as controller of climate change impact. The District Government of Nagan Raya has determined that the protection function of peat ecosystem  and sustainability function into Article 27 ( 2 ) Nagan Raya District Local Law (Qanun) Number 11, 2015 regarding spatial planning and Nagan Raya District Area of peat ecosystem as meant by versus ( 1 ) with its width 11.380,71 ha located in Kecamatan Darul Makmur is widespread in Babah Lueng Village, Kuala Seumayam, Pulo Kruet and Sumber Bakti. In practice, the peat areas in Babah Lueng Village, Kuala Seumayam, Pulo Kruet and Sumber Bakti has been converted by palm plantation and people amongst the plantation area hence the function of the area has been transformed. The research shows that an effort of conserving and reserving the peat ecosystem in Nagan Raya District has not been optimal hence its exploitation is still taking place at the ecosystem and its protection function.

his paper propuses Aceh public expenditure policy in economic developmentespecially in the area of an improvement in the living conditions of the majority of anation‟s citizens- not only in their physical well-being but also improvements insuch aspects as their spiritual life, general happiness, right to be free, and the rightand ability to enjoy the beauties of nature. We argue based on shari’ah oriented thatpublic expenditure accelerates economic development by giving priorities topreserve the necessary interest that are preserved ad-dien (religion), an-nafs (life orself), al-‘aqal (intellect), an-nasb (family or progeny) and al-maal (property orwealth), the government will create a healthy conditions or environment foreconomic activities to achieve Islamic development goals in Aceh Province.

Tujuan penelitian adalah untuk mengkaji efektivitas pembagian harta bersama terhadap perceraian di pengadilan agama sungguminasa kelas IB. Jenis penelitian hukum normative. Jenis data sekunder yaitu Putusan Pengadilan Agama Kabupaten Gowa Nomor 79/Pdt.G/2017/Pa.Sgm. Teknik pengumpulan bahan hukum Studi Kepustakaan. Analisis data kualitatif. Hasil penelitian menunjukkan efektivitas pembagian harta Bersama berasarkan putusan nomor 79/PDT.G/2017/PA. SGM telah efektif yang ditunjau berdasar kedudukan Hukum (legal standing) yang diperoleh penggugat serta partisipasi Pemerintah dan Aparat dalam membantu penggugat mendapatkan haknya efektif karena telah memenuhi mekanisme hukum yang ada. Adapun faktor-faktor yang mempengaruhi efektivitas pembagian harta bersama terhadap perceraian pada putusan nomor 79/PDT.G/2017/PA. SGM meliputi pada factor sosiologi yaitu penetapan putusan dan adanya pendukung seperti fasilitas. Sedangkan factor psikologi meliputi pada ketidakadilan ini sangat berkaitan dengan pola padang suami selaku penanggungjawab keluarga terhadap istri selaku ibu rumah tangga serta pengaruh budaya dan ideologi yang menjadi pertimbangan dalam memberikan hak seorang istri. The aim of the study was to examine the effectiveness of the sharing of joint assets on divorce in the class IB sungguminasa religion court. This study is normative legal research. The type of secondary data is the Decision of the Religion Court of Gowa Regency Number 79 / PDT. G / 2017 / Pa. Sgm. The technique of collecting legal materials used in this research is Library Research. The data analysis used is qualitative analysis. The results showed the effectiveness of sharing joint assets based on decision number 79 / PDT.G / 2017 / PA. SGM has been effective based on the legal standing obtained by the plaintiff and the participation of the Government and the Apparatus in helping the plaintiff get his / her rights effectively because it has fulfilled the existing legal mechanisms. The factors that affect the effectiveness of the sharing of joint assets include sociological factors, namely the decision making and the existence of supporters such as facilities. While the psychological factor covering this injustice is closely related to the perspective of the husband as the head of the family and the wife as a housewife, as well as the influence of culture and ideology that are considered in giving the rights of a wife.

This research discusses the proliferation of underage beggars in Banda Aceh, the capital of the Aceh province, Indonesia. This case confronts the local law, namely Qanun No. 11 of 2013 articles 45 and paragraphs 46. The focus of this study was to identify the effectiveness of direct and indirect monitoring and inspecting of underage beggars in this capital city, and at the same time to observe the obstacles encountered in handling this issue. A qualitative method was employed in collecting the data through observation, interviews, and documentation. The result of the investigation affirmed that the obstacle in overcoming beggars is the unavailability of social rehabilitation centers. Besides, beggars who are caught are only managed after they are released, then they repeat their actions because they are constrained by their daily needs. The patrol work carried out by the Office of Social Affairs often battled with resistance, such as when they rebelled and tried to escape in order to be caught by the officers. Most beggars in the capital city of Aceh are categorized as children and elderly people so that when conducting training, it is difficult to give punishment like to other beggars. Furthermore, the minimal budget provided by the government to curb beggars also becomes a challenge, especially to control underage beggars with routine patrols.
