<p class="1judul"><em>Absolute Accountability Corporations because Land Fire Causes Pollution / Environmental Damage. </em></p><h1><span lang="EN-US">As a legal subject, in carrying out business activities, each corporation is obliged to maintain the sustainability of environmental functions, by preventing pollution / damage from exceeding the quality standards / standard criteria for environmental damage. In fact, there are various corporations whose land is burned, resulting in pollution / damage exceeding the quality standards / standard criteria for environmental damage. This study discusses the absolute responsibility of corporations because land fires result in pollution / damage exceeding the quality standards / standard criteria for environmental damage. In connection with this, this study discusses further about the application, constraints, and solutions to the application of absolute responsibility to corporations because land fires result in pollution / damage exceeding the quality standards / standard criteria for environmental damage. This study uses a type of normative legal research, with a holistic normative juridical method, and is descriptive analytical. The results of the study concluded that not all Judges of the public justice institutions applied absolute responsibility to corporations because land fires resulted in pollution / damage exceeding the quality standards / standard criteria for environmental damage. There are 4 (four) constraints and 7 (seven) solutions to the application of absolute responsibility to corporations because land fires result in pollution / damage exceeding the quality standards / standard criteria for environmental damage.<strong></strong></span></h1>

Penerapan Instrumen Ekonomi Lingkungan Hidup dalam ketentuan Pasal 42 dan 43 Undang-Undang No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup dapat dilihat sebagai upaya mewujudkan pembangunan berkelanjutan yaitu memberikan perlindungan pada lingkungan hidup melalui pendekatan yang sejalan dengan kaidah-kaidah pasar ekonomi, sehingga upaya pengelolaan lingkungan hidup tidak mengganggu pertumbuhan sektor usaha dan ekonomi makro pada umumnya. Instrumen ekonomi lingkungan hidup (salah satunya adalah insentif dan/atau disinsentif) ini wajib dikembangkan dan diterapkan oleh Pemerintah dan pemerintah daerah dalam rangka melestarikan fungsi lingkungan hidup. Tujuan instrumen insentif dan/atau disinsentif ini adalah untuk melestarikan fungsi lingkungan hidup melalui pemberian kredit perbankan kepada nasabah debitur. Penelitianini dilakukan dengan metode penelitian hukum normatif dengan studi kepustakaan. Hasil dari penelitian ini adalah bahwa penerapan instrumen insentif dan/atau disinsentif ini sangat signifikan untuk mencegah terjadinya pencemaran dan perusakan lingkungan hidup karena sejak dari awal nasabah debitur yang mengajukan kredit/pembiayaan atas usaha dan/atau kegiatannya sudah dapat diketahui apakah nasabah debitur tersebut peduli atau lalai terhadap lingkungan hidup. Dengan penerapan instrumen insentif dan/atau disinsentif dalam pemberian kredit perbankan terhadap nasabah debitur maka dapat dipastikan pelestarian fungsi lingkungan hidup tetap terjaga dan kredit/pembiayaan yang diberikan perbankan kepada nasabah debitur tidak terjadi kredit macet   Application of Environmental Economic Instruments in the provisions of Article 42 and 43 of Law No. 32 of 2009 concerning Environmental Protection and Management can be seen as an effort to realize sustainable development. These instruments provide protection to the environment through approaches that are in line with economic market rules, so that environmental management would not disrupt the business sector and macro economy growth. These environmental economic instruments must be developed and applied by the government in order to preserve environmental functions. Using normative legal research methods the results of this study show that the application of these incentive and / or disincentive instruments is significantly prevent the occurrence of pollution and environmental damage. Since the beginning the provision banks can identify whether the debtor customer cares or neglectful about the environment. By implementing incentive and / or disincentives instruments in the provision of bank credit to debtor customers, the preservation of environmental functions could be maintained, and bad credit/ financing could be avoided.

The corporation as an entity or legal subject whose existence contributes greatly in promoting economic growth and national development. However in reality, it is often for corporations to commit various criminal acts (corporate crime) that have a detrimental impact on the state and people. This research is normative legal research. Legal research which places the law as a normative system. The research approach uses a statutory approach and a conceptual approach. The results showed that the enactment of the Supreme Court Regulation No. 13 Year 2016 was to clarify the guidelines for the Public Prosecutor in prosecuting corporate defendants in corruption criminal acts. The application of sanctions against corporations as perpetrators of corruption is carried out as an effort to recover the losses of the State and the restoration of the state’s economy is an appropriate step considering the essence of criminal punishment in eradicating criminal acts of corruption aimed at recovering state losses or the state’s economy.

This study is based on the legal responsibility of the assessment of public appraisal reports they make in land procurement activities for development in the public interest. Public assessment is obliged to always be accountable for their assessment. The type of research found in this thesis is a type of normative legal research with the right-hand of the statue approach and case approach. Normative legal research is a study that provides systematic explanation of rules governing a certain legal category, analyzing the relationship between regulations explaining areas of difficulty and possibly predicting future development. . After conducting research, researchers found that one of the causes that made the dispute was a lack of communication conducted between the Government and the landlord. In deliberation which should be the place where the parties find the meeting point between the parties on the magnitude of the damages that will be given, in the field is often used only for the delivery of the assessment of the compensation that has been done.

Waste Technology (end of pipe technology) are widely used to cope with environmental pollution, both for liquid waste, solid and air. Waste processing technology developed for the waste can be in accordance with quality standards thathave been established, while monitoring technology has been developed either manually or automatically. The most important part in a Book of Criminal Law (Penal Code) is a prison, because the prison contains rules about the size and implementation of the criminal. The position of life imprisonment in the national criminal justice system is still considered relevant as a means of crime prevention, it can be seen from the number of offenses punishable with life imprisonment. However, life imprisonment is considered contrary to the penal system. This study aims to investigate the implementation of life imprisonment, weaknesses, and the solution in the future. The approach used in the study is a non-doctrinal legal research with socio-legal research types (Juridical Sociological).The results of research studies show that life imprisonment is contrary to prison system, and life imprisonment become an obstacle to fostering convicts back into society. Bill Criminal Code of September 2019 can be used as a solution to life imprisonment change in the future. Presented advice, in order to be disseminated to the application of the criminal purpose of the Criminal Code of Prison adopted in the future, so that the public and experts no longer make the criminal as a form of retaliation.Keywords: Reconstruction; Crime; Prison; Life Imprisonment; System; Corrections.

This research is a normative legal research using constitutional and case study approach. The result of this research show that Bank Mega liquefyPT. Elnusadeposito funds carelessly without PT.Elnusa consent is an act against the law. Elnusa merupakan tindakan yang melanggar hukum. Bank Mega telah tidak memenuhi kewajibannya terhadap nasabah sebagaimana diatur dalam Pasal 37 B ayat (1) Undang-Undang Nomor 10 Tahun 1998 tentang Perbankan yang menyebutkan bahwa setiap bank wajib menjamin dana masyarakat yang disimpan pada bank yang bersangkutan. Tindakan Bank Mega telah menimbulkan kerugian baik materiil maupun immateriil sehingga Bank Mega selaku pelaku usaha berdasarkan Pasal 19 ayat (2) Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen bertanggung jawab untuk memberikan ganti rugi atas kerusakan, pencemaran, dan/atau kerugian konsumen akibat mengkonsumsi barang dan/atau jasa yang dihasilkan.</p><p>Kata Kunci: Tanggung jawab; prinsip kehati-hatian; bank; dan nasabah.</p>

One of the functions of political parties in legislation is as a means of political education and socialization. Political parties are obliged to disseminate their political discourse to the public. However, in its implementation in the field, there are still political parties that have not maximized their function in providing political education to the public. This study discusses (1) What is the function of political parties in providing public political education and its influence on public participation in general elections? (2) What are the implications of political parties that do not implement public political education? This research was conducted by using normative legal research methods, primary and secondary sources of legal materials, methods of collecting legal materials using statute records and others, and analyzing legal materials using descriptive analysis methods. The results of this study indicate that according to Law No.2 of 2011, one of the functions of political parties is to provide political education as a means of education for the wider community to become Indonesian citizens who are aware of their rights and obligations in public. The importance of political education carried out by political parties to the maximum and in its actual essence will be able to have a very good impact on society, which means that people are able to become people who are aware of their obligations in giving choices to political parties or candidates who are true and sincere in terms of welfare. people. The implication of political parties that do not carry out public political education is to cause a decrease in public participation in general elections and this will also lead to apparently unhealthy political conditions and allow high abstention due to low levels of public participation.

AbstractMedical actions by doctors who act not in accordance with the rules and applicable moral ethics are now beginning to emerge frequently. At this time, the problem of malpractice in health services began to be discussed by various groups in the community. This can be seen from the many indictments of malpractice cases submitted by the public about the profession of doctors who in carrying out their duties have committed wrong actions that result in losses resulting in death or disability. Medical malpractice, this is related to the task of the doctor or medical personnel under his command intentionally or negligence to do something (active or passive). The problem that the writer takes here is that the malpractice case which the writer carefully sourced from the decision of Nganjuk District Court No.288 / Pid.sus / 2018 / PN NJK, The theory used in this research is the theory of law enforcement. While the method used is empirical juridical legal research, where in analyzing the problem carried out by the method of combining legal materials (Decisions) with primary data obtained in the field. Permasalahan yang penulis ambil disini dimana Kasus malpraktek yang penulis teliti bersumber pada putusan Pengadilan Negeri Nganjuk No.288/Pid.sus/2018/PN NJK, Teori yang digunakan dalam penelitian ini ialah teori penegakan hukum. Sementara metode yang digunakan adalah penelitian hukum yuridis empiris, dimana dalam menganalisis permasalahan dilakukan dengan metode memadukan bahan-bahan hukum (Putusan) dengan data primer yang diperoleh di lapangan. Adapun output dari tulisan ini, bahwa penanganan perkara malpraktek dokter yang diilakukan dokter tanpa danya prosedur sesuai aturan medis perlu di perhatikan.Kata kunci : Aborsi, Dokter, Malpraktek,Penegakan Hukum.

An auction is an activity of selling of goods in public by means of a verbal-bid to get the higher price or to get lower prices and the price quote can be done in a closed and written. This is done by the way of collecting the prospective buyers of the auction led by officials of the auction. In this case, the intended auction was the sale of goods that are held publicly. The auction, according to the regulations of security right, is when the debtor made a breach, the holder of the security rights have the right to sell the security rights’ objects over its own power through a public auction as well as taking payment of account receivable from the sale proceeds. An auction is an alternative to the sale of an undertaken asset by way of inviting prospective buyers at a particular time and place in which the last highest bidder in writing or orally is determined as the winner. The author used socio-legal research as his research method. To meet the forth standards set by the law, the auction should be widely announced to the public, either through printed file, electronic or visual. A legal certainty as a basis which concerned with propriety and justice is very closely related to the principle of auction sales in another. Based on the history before the reform era, there have been many cases of government committing corruption, collusion and nepotism, this is the background of the movement to create a government to run good governance. As time has progressed, the time has come for a time that is all full of digitalization, both in the economy, education and politics. This research uses normative legal research methods. This study shows that the government in running its government will also be based on the development of sophisticated information technology which can be called E-Government. Therefore, there is now a time when the Indonesian government has used and allowed the Online Single Submission (OSS) system to make it easier for people who want to take care of business licensing. The implementation of good governance during the Industry 4.0 Revolution can take advantage of science, technology and information to provide good facilities and services to the Indonesian people, and the public can easily access government information.
