The concept of marriage guardians in Islamic Law Compilation still seems biased and patriarchal, because women do not have the right to marry themselves or others. Articles on guardian of marriage are still less responsive to women's interests. A gender imbalance regarding the concept of marriage guardians is further strengthened by the provisions of marriage guardians in the Islamic Law Compilation which are strictly aimed at men. This research used literature review method based on the Compilation of Islamic Law and gender theory. This study found that, the information about guardian of marriage which is a man’s right from the father's line is actually in line with the pagan Arab culture, including the contribution of Quraish hegemony in interpreting religious propositions. In this regard, Arab societies like Quraish had great respect for a person based on their lineage, so that everyone who was respected would wholeheartedly keep their honor. The lineage in Arabic culture is in the hands of the male lineage, and women are entered into second-class citizens in front of them.

In the discipline of Islamic law research, strong proofing and clear Istinbat method are key pillars in the construction of Islamic law based on the application of the science of usul al-fiqh and maqasid al-shari'ah. However, what happens at the state of Johor’s fatwa institution is the opposite. The fatwa research methods applied by the Fatwa Committee of Johor in resolving current fatwa issues is not based on the right and true discipline of Islamic law research. In fact, current inputs related to fatwa issues are not explicitly stated in the method of determining the law either in the form of reality or scientifically verified. Therefore, this paper will discuss the fatwa procedures undertaken by the Fatwa Committee of Johor based on the methods applied in resolving current issues. The research methodology adopted is library and interview methods. This study shows that fatwa management and production in the state of Johor is placed under the jurisdiction of the Mufti of Johor’s Department. The methods adopted by the Fatwa Committee of Johor covers two methods, namely: internal research methods including literature review through the application of original source and proofs based on syarak. Second: field research method that includes an external review or going to the location of study such as conducting observation, questionnaires and interviews including referrals to specialists of different fields. Maslahah and mafsdah consideration are also implemented by the Fatwa Committee in every fatwa decision based on the standard that meets the interests of maqasid al-shari'ah. Namun begitu, apa yang berlaku di institusi fatwa negeri Johor adalah sebaliknya. Kaedah penyelidikan fatwa yang diaplikasi oleh Jawatankuasa Fatwa Negeri Johor dalam menyelesaikan isu fatwa semasa tidak berasaskan kepada disiplin penyelidikan hukum Islam yang tepat dan sebenar. Malahan input-input semasa yang berkaitan dengan isu fatwa juga tidak dinyatakan secara jelas dalam kaedah penentuan hukum sama ada dalam bentuk realiti yang berlaku atau pembuktian secara saintifik. Justeru, kertas kerja ini akan membincangkan prosedur fatwa Jawatankuasa Fatwa Negeri Johor berdasarkan metode-metode yang diaplikasi dalam menyelesaikan isu-isu yang bersifat semasa. Metodologi kajian yang digunakan dalam kajian ini adalah melalui metode perpustakaan dan metode lapangan. Hasil kajian menunjukkan bahawa pengurusan dan pengeluaran fatwa di negeri Johor hanya terletak di bawah bidang kuasa Jabatan Mufti Johor. Metode fatwa yang diamalkan oleh Jawatankuasa Fatwa Negeri Johor merangkumi dua metode iaitu pertama, kaedah penyelidikan dalaman yang merangkumi kajian kepustakaan menerusi pengaplikasian dari sumber asas dan dalil-dalil syarak. Kedua, kaedah penyelidikan lapangan yang meliputi kajian luaran atau turun ke lokasi kajian seperti observasi, soal selidik dan temubual dan rujukan kepada pakar dalam bidang yang berlainan. Pertimbangan maslahah dan mafsdah juga dimplementasikan oleh Jawatankuasa Fatwa dalam setiap keputusan fatwanya berasaskan standard yang menepati kepentingan maqasid al-shari’ah. The existing Lampung Indigenous Peoples Pepadun in Tigeneneng sub-district, Kab. Pesawaran, adheres to a patrilneal kinship system. This means that the oldest son is an absolute heir in the implementation and management of inheritance with the highest customary title, namely balancing. Whereas for the female heirs, they were not given the right of authority in management, because in the adat of Lampung Province the daughters were considered unable to manage inheritance and daughters when they were married, so they would change their customary titles and would follow their husbands. This type of research is a field using a qualitative approach by analyzing data inductively. The result of this research is that the system applied in the distribution of inheritance rights to the eldest child in the Lampung tribal community, is clearly very contrary to the principle of gender equality and justice. Juridically normative equality and gender justice have been regulated in Islamic Law and International Convention (CEDAW). Even though juridically, girls have the same rights as boys in managing inheritance left by both parents.

Penelitian ini ingin menjawab kesesuaian Qanun Aceh dengan sistem peraturan perundang-undangan, dengan mengidentifikasi kedudukan qanun dalam sistem peraturan perundang-undangan, dan kewenangan lembaga dalam hak uji materil terhadap qanun sebagai produk hukum. Penelitian ini bersifat yuridis-formil melalui kajian pustaka terhadap peraturan perundang-undangan untuk mendeskripsikan kesesuaian qanun Aceh dalam sistem peraturan perundang-undangan. Penelitian ini menemukan bahwa Qanun Aceh ada yang berkaitan dengan penyelenggaraan pemerintahan dan ada yang berkaitan dengan pelaksanaan syariat Islam kedudukannya dianggap sama dengan peraturan daerah pada umumnya dalam perspektif Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan. Argumentasi yuridis yang menyatakan bahwa qanun sejajar dengan peraturan daerah ini diperkuat oleh Peraturan Menteri Dalam Negeri Republik Indonesia Nomor 53 Tahun 2011 tentang Pembentukan Produk Hukum Daerah. Namun berkenaan dengan hak menguji untuk membatalkan Qanun Aceh dalam pelaksanaan syariat Islam hanya dapat diuji dan dibatalkan melalui judicial review oleh Mahkamah Agung sebagaimana diatur dalam Pasal 235 ayat (4) UU Nomor 11 Tahun 2006. Asking for Aceh Qanun Legality: Compatible With Legislation System This study aims to answer the compatibility between the Aceh Qanun and the system of legislation by identifying the position of qanun in the system and the authority of the institution in the rights to materially verify qanun as a legal product. This study uses a juridical-formal method through a literature review of the laws and regulations to describe the suitability of the Aceh qanun in the statutory system. This study found that the Aceh Qanun relating to the administration of government and relating to the implementation of Islamic law, its position is considered the same as local regulations in general in the perspective of Law No. 12/2011 on the Formation of Legislation. The juridical argument that states that the qanun is in line with this regional regulation is reinforced by the Republic of Indonesia Minister of Home Affairs Regulation No. 53/2011 on the Establishment of Regional Legal Products. However, the right to examine the cancellation of qanun in the implementation of Islamic Shari'a, it can only be examined and canceled through a judicial review by the Supreme Court as stipulated in Article 235 paragraph (4) of Law Number 11/2006.

Abstract: The existence of women in the context of strategic leadership in various lines of life including in government becomes a controversial issue among classical and contemporary scholars. Some scholars tend to allow women to be leaders in strategic positions, while some other scholars tend not to allow women to be leaders. Their views on whether or not women can become leaders are supported by each of the arguments they build. However, if each of the arguments they build is analyzed comprehensively, then it seems that the more logical and rational views of the scholars who tend to allow women to become leaders with consideration of the benefits and interpretations that will result. The implications of this are creative, innovative, constructive and gender equality perspectives in the context of leadership in all walks of life of people, nations and countries in the current era of globalization, reform and advancement of information technology. Women's leadership becomes a public issue that is always hotly discussed, even provoking polemics and debates between the pros and cons of women's leadership in the State or other public spheres. Despite the recognition of basic human rights including the right of women to be equal with men, it seems to have experienced a significant increase in various parts of the world. In terms of leadership, the position of women is still faced with the position of men. Religious teachings are considered to have long oppressed women. Teachings having been dominated by men have been used as justifications for the perception of society that is very detrimental to women. This article discusses the gap of understanding on women's rights to reconcile with their husband who have divorced them, viewed from the perspective of Islamic scholars and Islamic law. In this case, the Qur'an has the principle that the positions of men and women are equal as a servant, because men and women are created from the same substance (min nafsin waahidah), the same task (khalifatullah filardh), and have same obligations (liya'budun). However, Muslim scholars agree that the reconciliation is absolutely the husband’s right. In gender perspective, women can apply for reconciliation (Rujuk) as their rights to their husbands. This study conducts analysis using a content analysis approach related to the issue of reconciliation rights dominated by men (husbands) by means of redeeming the husband's rights that have been given to them. And in the presence of khulu, the wife also has the right of reconciliation (Rujuk) to the husband who has divorced her.

 Abstract. Exit of the Beijing Platform For Action (BPFA) on gender equality mainstreaming was incorporated into development policy during the fourth world women's conference in Beijing in 1995 so Abdurrahman Wahid declared Presidential Instruction number 19 December 2000. 9 of 2000 on gender mainstreaming in national development. This is where the islamic boarding school  is required to be able to respond to the dynamics of the era along with the development of modernization and globalization, so that islamic boarding school  can answer the issue of gender equality discourse that goes into the boarding booths. This paper wants to answer how the strategy and implementation of  Gender Mainstreaming in islamic boarding school  education. This review is literature review using feminist approach and gender analysis in Islam. After the review, the authors found that the strategy for realizing gender mainstreaming in islamic boarding school  education is to re-design the gender perspective teaching curriculum and the implementation of Gender Mainstreaming is through the main stakeholders of islamic boarding school  namely Kyai, Nyai, Ustadzah and ustadz.Abstrak. Dikeluarkannya Beijing Platform For Action (BPFA) tentang gender mainstreaming (PUG) kesetaraan gender masuk dalam kebijakan pembangunan pada saat konferensi perempuan dunia keempat di Beijing tahun 1995 sehingga Presiden Abdurrahman Wahid pada tanggal 19 desember 2000 mengeluarkan Instruksi Presiden (Inpres) No. 9 Tahun 2000 tentang pengarusutamaan gender dalam pembangunan nasional. Disinilah pesantren dituntut untuk mampu merespon dinamika zaman seiring berkembangnya arus modernisasi dan globalisasi, sehingga pesantren mampu menjawab persoalan wacana kesetaraan gender yang masuk ke dalam bilik-bilik pesantren. Tulisan ini ingin menjawab bagaimana strategi dan implementasi PUG dalam pendidikan pesantren. Kajian ini adalah kajian pustaka dengan menggunakan pendekatan feminis dan analisa gender dalam Islam. Setelah dilakukan kajian, penulis menemukan bahwa strategi untuk mewujudkan PUG dalam pendidikan pesantren adalah melakukan re-desain kurikulum pengajaran berprespektif gender dan implementasi PUG adalah melalui pemangku utama pesantren yaitu Kyai, Nyai, Ustadzah dan ustadz.

Limitations of action designate extent of time after an event, as set by statutes of limitations, within which legal action can be initiated by a party to a transaction. No event is actionable outside the designated time as same is rendered statute-barred. This study aims to provide an insight into application and significance of Limitations Act 1950 and Limitation Ordinance 1952 to Islamic banking matters in Malaysia as well as Shariah viewpoint on the issue of limitation of action. In conducting the study, a qualitative research methodology is employed where reported Islamic banking cases from 1983 to 2018 in Malaysia were reviewed and analysed to ascertain the application of those statutes of limitations to Islamic banking. Likewise, relevant provisions of the statutes as invoked in the cases were examined to determine possible legislative conflicts between the provisions and the rule of Islamic law in governing the right and limitation of action in Islamic banking cases under the law. The reviewed cases show the extent to which statutes of limitations were invoked in Malaysian courts in determining validity of Islamic banking matters. The limitation provisions so referred to are largely sections 6(1)(a) and 21(1) Limitations Act 1953 and section 19 Limitation Ordinance 1953, which do not conflict with Shariah viewpoint on the matter. This study will prove invaluable to financial institutions and their customers alike in promoting knowledge and creating awareness over actionable event in the course of their transactions.

In Islamic law judgements on any human action are usually evaluated in terms of the intention involved. Accordingly, the rules of substantive issues have to be accommodated under the basic principles of Islamic jurisprudence. The understanding of these principles by the juristic scholar is highly rewarding because it will lead the muftī to the right path in deriving legal opinions from the original sources. The basic principle of Islamic jurisprudence, which stipulates that ‘all actions depend on intentions,’ has played an important role in the construction of Islamic jurisprudence. Moreover, this rule has a special place in the theory of Islamic legal contract. So what is the effect of intention in the validity of human actions and legal contracts? It is known that pure intention has significant effects on spiritual worship and legal contracts of transaction. It also gives guidance for earning rewards from Almighty Allah. This article concentrates on the effect of intention in perpetual worship, the concept of action and intention in Islamic legal works, the kind of contract with all its components, and the jurists' views on the effects of intention in human action and legal contract along with their discussion and counter-arguments.

SummaryThe biomechanical characteristics of 1.2 mm diameter allogeneic cortical bone pins harvested from the canine tibia were evaluated and compared to 1.1 mm diameter stainless steel pins and 1.3 mm diameter polydioxanone (PDS) pins using impact testing and four-point bending. The biomechanical performance of allogeneic cortical bone pins using impact testing was uniform with no significant differences between sites, side, and gender. In four-point bending, cortical bone pins harvested from the left tibia (204.8 ± 77.4 N/mm) were significantly stiffer than the right tibia (123.7 ± 54.4 N/mm, P=0.0001). The site of bone pin harvest also had a significant effect on stiffness, but this was dependent on interactions with gender and side. Site C in male dogs had the highest mean stiffness in the left tibia (224.4 ± 40.4 N/mm), but lowest stiffness in the right tibia (84.9 ± 24.2 N/mm). Site A in female dogs had the highest mean stiffness in the left tibia (344.9 ± 117.4 N/mm), but lowest stiffness in the right tibia (60.8 ± 3.7 N/mm). The raw and adjusted bending properties of 1.2 mm cortical bone pins were significantly better than 1.3 mm PDS pins, but significantly worse than 1.1 mm stainless steel pins (P<0.0001). In conclusion, cortical bone pins may be suitable as an implant for fracture fixation based on initial biomechanical comparison to stainless steel and PDS pins used in clinical practice.
